Premises liability is a broad area of personal injury law. It covers many different situations and circumstances in which
a person(s) can be injured, or the injuries result in death. The law regarding these claims is constantly changing and can be very confusing and complicated to determine where the responsibility and liability for the injuries lie, so it is imperative you contact an attorney as soon as possible after the incident to examine the facts and help determine if a case can be made.

“Premises Liability” refers to the ability to hold owners and occupiers of property legally responsible for accidents and injuries that occur on that property. A property owner or occupier must take reasonable steps to make sure that their property is safe and/or in some cases, the property owner or occupier must warn people on their property of any dangerous conditions. Owners and occupiers of land, such as business owners, landlords, and tenants have a legal duty to maintain their property in a condition that is safe for others. If it is provable that the property owner or occupier’s failure to take reasonable steps to provide a safe property results in an injury, then the injured person
may be able to recover monetary damages from the negligent owner or occupier.

There are certain situations that arise when the negligence of a property owner or occupier results in serious or catastrophic injury.

PREMISES CLAIM TIPS

It is often said that knowledge is power. Exercise power over your claim by taking some simple steps so that you do NOT compromise your claim or impede your ability to be properly compensated down the road:

Always call the Police if you are hurt on another’s property due to a defective condition, you will need accident report. If you are at a retail or grocery store, ask for a manager and make an incident report; ask for a copy before you leave.

Never admit fault

Never, never, never sign anything from the store or from an insurance company

Never talk to anyone from an insurance company or give a statement without first seeking the advice of an attorney

If you have a camera phone take pictures of your property/defective condition.

Try to get the names, phone numbers and addresses of any witnesses

If you are injured at all, go to the local hospital’s ER (insurance companies will claim later that you must not have been badly hurt, even if you are, if you do not go to the ER after an accident).

EXPERIENCED TEXAS WORKERS’ COMPENSATION ATTORNEYS CAN AND DO MAKE THE DIFFERENCE

The amount of benefits, both indemnity and medical, at stake in workers’ compensation claims can be staggering. Workers’ compensation income benefits can last up to 401 weeks (almost 8 years) and in Texas, an injured worker
is entitled to medical benefits that are reasonable and necessary to treat their compensable injury for the rest of the injured worker’s life. As you can see, combined medical and income benefits can total hundreds of thousands
of dollars

TEXAS WORKERS’ COMPENSATION LAW IS COMPLICATED

Texas workers’ compensation law is complex and constantly changing. The law has deadlines and filing requirements, the failure of which to meet can be devastating to your claim. Texas is the only state in the United States that does not mandate that employers carry workers’ compensation insurance. If you are injured at work due to the negligence of your employer or a fellow employee and your employer has made the decision to not purchase workers’ compensation insurance to protect its workers, we can and will help you investigate, file and aggressively pursue a personal
injury claim.

However, if your employer has workers’ compensation insurance, you will need an experienced, resourceful and professional workers’ compensation attorney to aggressively pursue benefits for you and your family. Remember, often insurance companies are in business to make a profit. One way insurance companies make profits is to collect premiums and deny claims. Unless you know the law, you are likely to get fewer benefits than you deserve or perhaps no benefits at all. Let us help you avoid mistakes that could cost you tens of thousands of dollars and affect your health, future and the future of your family. Don’t wait until it’s too late. Almost every day we receive calls from injured workers’ who have lost everything or received something less that they were entitled to because they were not properly represented by a non-lawyer, relied upon erroneous non-lawyer legal advice or simply did not know the law.

STATE EMPLOYEE OMBUDSMAN ARE NOT ATTORNEYS AND
ARE PROHIBITED FROM THE PRACTICE OF LAW IN TEXAS

You know the old saying, “you get what you pay for.” You may be advised to contact or use the free services of a state employee Ombudsman who work for the Office of Injured Employee Counsel. Be advised that Ombudsmen are not lawyers and any lawyers who happen to be employed by the Office of Employee Counsel are prohibited by Texas law from becoming your lawyer and representing you in any hearing or proceeding.

With so much at stake, why would you trust your claim with anyone other than an experienced workers’ compensation attorney? In Texas, insurance companies are represented over 90% of the time at benefit hearings by experienced, resourceful, and professional workers’ compensation attorneys. These attorneys aggressively represent insurance companies. They know the law, know how to obtain evidence, and know how to present the evidence before an administrative law judge or hearing officer.

The attorneys of J.A. DAVIS have the EXPERIENCE AND RESOURCES necessary to successfully fight INSURANCE COMPANIES AND THEIR LAWYERS and we have the track record to prove it.

Remember, insurance companies hire experienced, resourceful, and professional workers’ compensation attorneys to protect their interests; shouldn’t you? Level the playing field. MAKE SURE THE INSURANCE COMPANY GIVES YOU EVERY DOLLAR/BENEFIT YOU DESERVE! CALL J.A. DAVIS TODAY!

According to the National Highway Traffic Safety Administration (NHTSA) there are over 6 million traffic accidents reported by the police last year. Over 41,000 individuals were killed and an approximately 3.2 million people were injured as a result.

First, understand that each and every accident is different. Each individual involved and injured in an accident will
have their own set of damages, individual injuries, and specific losses. While most accidents are caused by negligence and/or a momentary lapse of attention, some are caused by reckless behavior. Examples of reckless behavior include operating vehicles at unsafe/reckless rates of speed, driving under the influence, or “texting while driving.”

Every driver in Texas is required by law to exercise responsibility and caution when operating a motor vehicle.
A driver is legally obligated to drive in a cautious manner so as not to place any other passengers or other motorists
in danger. If you have been in an accident caused by someone else’s negligence, you are entitled to seek compensation
for your injury.

The attorneys at J.A. DAVIS know an injury caused by an automobile accident can be physically and emotionally challenging. You will have unexpected bills, loss of income, and short and/or long-term pain and suffering.
Many times an injured victim needs assistance in seeking and securing quality medical care; WE CAN HELP!

LET THE ATTORNEYS AT THE LAW OFFICES OF JA DAVIS GIVE YOU THE HELP YOU NEED.
CALL J.A. DAVIS NOW FOR A FREE CONSULTATION.

AUTO ACCIDENT TIPS

It is often said that knowledge is power. Exercise power over your claim by taking some simple steps so
that you do NOT compromise your claim or impede your ability to be properly compensated down the road:

Always call the police; you will need an accident report

Never admit fault

Never, never, never sign anything from an insurance company. Insurance companies are tricking people into signing releases stating, “sign this and it will help you begin to cover your medical expenses”. Don’t be fooled,
the document/check they are asking you to sign is a release of liability and you have just thrown away your
chance to be properly compensated.

Never talk to anyone from an insurance company or give a statement without first seeking the advice of an attorney

Do not talk to anyone, other than the police officer or if applicable medical personnel, before you talk to an attorney

If you have a camera phone take pictures of your vehicle and the driver’s vehicle including their license plates
and the license plates of any witnesses in case their names are not properly recorded in the police report

Try to get the names, phone numbers and addresses of any witnesses

If you are injured at all, go to the local hospital’s ER (insurance companies will claim later that you must not have been badly hurt, even if you are, if you do not go to the ER after an accident). If you are taken to the hospital before speaking to the police officer, politely request that the officer speak to you at the hospital. In serious injury matters, the police are often unable to accompany an injured person to the hospital and obtain the injured person’s statement of what happened. If this happens it is important that you call the police department and insist on speaking to the investigating officer or his supervisor. If you cannot get the officer to speak to you; make sure you document that you tried to speak with the office and what efforts you made to speak to him.
